Apple is not a sponsor of this sweepstakes. The WinSpree Weekly Sweepstakes is sponsored and administered solely by WinSpree. Apple Inc. is not a sponsor of, and is not involved in any way with, this sweepstakes, and the same applies to Google LLC and any other app-store operator through which the App is distributed. See Section 24 below.

1. Acceptance of These Terms

These Official Rules and Terms & Conditions ("Terms") govern your access to and use of the WinSpree mobile application (the "App"), including the WinSpree Weekly Sweepstakes (the "Sweepstakes") and all games, features, and services offered within the App (collectively, the "Service"), operated by WinSpree ("WinSpree," "we," "us," or "the Sponsor"). By creating an account, entering the Sweepstakes, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

Using the App requires that you be at least 18 years of age, or the age of majority in your jurisdiction of residence if that is older. The Sweepstakes is open only to individuals who, at the time of entry, meet that age requirement and are: (a) legal residents of the fifty (50) United States (including the District of Columbia), Canada (excluding the Province of Quebec), Australia, or New Zealand; and (b) not located in, and not residents of, any jurisdiction where the Sweepstakes is prohibited or restricted by law. The Sweepstakes is VOID WHERE PROHIBITED. The App also supports account creation in Switzerland, where the Sweepstakes does not run. Swiss residents may create an account and play every game in the App free of charge, with the leaderboards and social features working normally, but they are not eligible to earn tickets or win prizes, and the App says so on the Sweepstakes screen rather than leaving you to find out. Residents of Quebec are likewise excluded from the Sweepstakes due to Quebec-specific contest regulations; if you reside in Quebec, you may use the App's games but are not eligible to earn tickets or win prizes. The App collects your date of birth and country of residence at account creation, together with your state or province if you reside in the United States or Canada, and checks them against the applicable age of majority for that jurisdiction (for example, 19 in Alabama and Nebraska, 21 in Mississippi, and 19 in British Columbia, New Brunswick, Newfoundland and Labrador, Nova Scotia, the Northwest Territories, Nunavut, and Yukon; 18 in Australia and New Zealand; 18 elsewhere) before an account may be created; providing a false date of birth or jurisdiction to circumvent this check is a violation of these Terms. Individuals who conduct the Sweepstakes are not eligible to win a prize. This means WinSpree's owner, its officers and directors, and any person who takes part in selecting winners or in the management of WinSpree; this exclusion is required by law in some of the jurisdictions in which the Sweepstakes runs. Those individuals may create an account and play every game in the App, but they cannot be awarded a prize. Everyone else is eligible on the same terms as every other participant, including the family and household members of the individuals described above. Winners are selected at random by an automated process from among all eligible Tickets, as described in Section 6, and no person involved in conducting the Sweepstakes can influence, review, or alter that selection. WinSpree reserves the right to verify eligibility and to disqualify any individual who does not meet these requirements at any time.

3. No Purchase Necessary — Free to Enter

NO PURCHASE, PAYMENT, OR FEE OF ANY KIND IS REQUIRED TO ENTER OR WIN THE SWEEPSTAKES. A purchase or payment will not increase your chances of winning. Every method of earning a Sweepstakes ticket described in Section 4 is available at no cost. The App does not sell tickets, entries, or any other mechanism to influence the outcome of the Sweepstakes for money, and no in-app purchases of any kind affect Sweepstakes odds.

4. How Tickets Are Earned

You may earn entries ("Tickets") into the weekly drawing through any combination of the following free methods, each subject to the mechanics implemented in the App at any given time: (a) a free daily account check-in. Check-ins award Tickets on a seven-day cycle that increases with consecutive days: one (1) Ticket on days 1, 2, 3, 5 and 6, five (5) Tickets on day 4, and ten (10) Tickets on day 7, after which the cycle begins again. A check-in is available once per calendar day (Pacific Time) and missing a day returns the cycle to day 1. WinSpree may change these amounts and this schedule at any time, and the current schedule is always shown in the App; (b) achieving a new personal-best score or the #1 global high score in an eligible in-App game, which awards bonus Tickets. A single result that is both a new personal best and the #1 global high score awards the #1 global high score amount only, not both amounts. These bonus Tickets are awarded immediately once per play session. A play session begins when you open a game and ends when you leave it. Any further personal-best or #1 global high score achieved within the same play session is still recorded and ranked, and the Tickets for it are held rather than forfeited: they are awarded to you when you leave the game. Only one held award accrues per play session, at the amount for the highest milestone reached in that session, however many further results you achieve; and (c) referring a friend who creates an account and redeems your referral code, which awards fifty (50) Tickets to you and fifty (50) Tickets to your friend. These Tickets are not awarded when the code is redeemed; they are awarded once your friend records their first personal-best score in any eligible in-App game, and each account may redeem one referral code and receive this award once. A referral code may be redeemed only while at least one of the two accounts involved — the account redeeming the code or the account whose code it is — was created no more than three (3) days earlier; a code cannot be redeemed between two accounts that are both older than that. Referral codes are issued by the App and are shown in the App. For a transitional period the App also accepts a username in place of a referral code, so that invitations sent before referral codes were introduced can still be redeemed; WinSpree may discontinue that at any time, after which only a referral code issued by the App will be accepted. (d) posting publicly about a prize you have already been paid (a "Proof-of-Payment Share"), which awards two hundred (200) Tickets. This method is offered only to a participant whose prize under Section 6 has actually been paid, and the offer is presented in the App once that payment has been recorded. Taking part is entirely optional: it is not a condition of receiving or keeping any prize, it is not part of the winner verification described in Section 7, and declining has no effect on that prize, on your account, or on any future drawing. To qualify, the post must be publicly visible on Instagram or TikTok — a feed post, a reel, or a story — must tag the WinSpree account on that platform (@win.spree), and must include both the hashtag #WinSpreeWinner and the disclosure hashtag #ad; the disclosure is required because WinSpree is providing Tickets in return for the post. You then submit the link to that post in the App. A person reviews each post before any Tickets are awarded, and WinSpree may decline a post that is not publicly visible, does not carry the required tag and hashtags, does not relate to a prize actually paid to you, or that WinSpree reasonably believes to be misleading. Where a post is declined you may correct it and submit a link again, up to a total of three (3) submissions for the same prize. Tickets under this method are awarded once per prize, however many links are submitted, and are not awarded at all until the review is completed; because they are awarded at that moment, they are entered into whichever weekly drawing is open then, which may not be the drawing in which the prize was won. The offer closes fourteen (14) days after the payment is recorded, after which no Tickets are awarded under this method for that prize. WinSpree does not ask for, and asks you not to include, your email address, your full legal name, or any account number or balance in the post: a screenshot that has been posted publicly can be copied and kept by others, and WinSpree cannot retrieve or delete it for you. No purchase or payment is necessary to take part in this method, and it is offered on the same terms to every participant whose prize has been paid. Promotional multiplier ("Last-Minute Sprint"): during the six (6) hours immediately preceding each weekly drawing — that is, from 9:00 AM to 3:00 PM Pacific Time on the day of that drawing — Tickets awarded by the methods described above are multiplied by two (2). Tickets earned during that period are entered into that same day’s drawing. The multiplier applies to the amount awarded and does not increase any limit on the number of Tickets that may be earned in a day; where such a limit would be exceeded, only the Tickets remaining under it are awarded. No purchase, payment, or advertisement viewing is necessary to participate in the multiplier period, which is offered on the same terms to all eligible entrants. WinSpree may change the multiplier or the length of the period, or discontinue it, at any time; the period and multiplier currently in effect are shown in the App. Watching advertisements is not a way to earn Tickets in current versions of the App. Earlier versions offered a Ticket for voluntarily watching a complete video advertisement, subject to a daily limit; that method has been discontinued, and it may continue to work on an older copy of the App until that copy is updated. The number of Tickets awarded for each method is determined by WinSpree and may change at any time without notice. Tickets have no cash value, cannot be transferred, sold, or redeemed for cash, and expire at the end of the weekly period in which they are earned. Because some Tickets are awarded based on game performance, your level of skill or effort in the games may affect the number of Tickets you accumulate; however, the Sweepstakes winner is ultimately determined by a random, chance-based drawing weighted by Ticket count as described in Section 6, not by skill or performance directly.

5. Sweepstakes Period

The Sweepstakes operates on a recurring weekly basis. Each drawing period begins on Sunday at 3:00 PM Pacific Time (PT) and closes the following Sunday at 3:00 PM Pacific Time, with the drawing conducted shortly after each period closes. The first drawing under this schedule will be held on Sunday, September 6, 2026 at 3:00 PM Pacific Time; no drawing is held for the partial period preceding it. Tickets earned in one weekly period do not carry over to subsequent periods. WinSpree may modify the schedule, frequency, or duration of drawing periods at any time.

6. Prizes, Odds, and Winner Selection

Each weekly drawing awards one (1) grand prize of $20 USD and five (5) secondary prizes of $2 USD each, delivered as a digital payout sent to the email address on the winner's account through an independent payout provider. The winner chooses how to receive the amount from the options that provider offers in their country, which typically include a transfer to a digital wallet such as PayPal or Venmo, a transfer to a bank account, a prepaid Visa card, or a gift card from a large catalogue of retailers; the options available in a given country are shown to the winner at the time of redemption and are not controlled by WinSpree. Prize values are stated and sent in U.S. dollars; where a winner resides outside the United States, the amount is converted into that winner's local currency (for example CAD, AUD, or NZD) at the rate the payout provider applies at the time of redemption. Any fee charged by the payout provider is borne by WinSpree, so the full amount awarded reaches the winner. A payout that has not been redeemed within thirty (30) days of being sent expires and is returned to WinSpree; WinSpree will make one (1) further attempt to reach that winner before the prize is treated as forfeited under Section 7. Prize amounts are subject to change by WinSpree at its sole discretion and as displayed in the App at the time of entry. Approximate total retail value (ARV) of all prizes in a given week is $30 USD. Winners are selected by random drawing from among all eligible Tickets earned during the applicable period, weighted such that each Ticket represents one chance to win; a participant with more Tickets has proportionally more chances but no guarantee of winning. Odds of winning depend on the total number of Tickets entered by all eligible participants during that period. No purchase or payment increases your odds. A single participant may not win more than one prize tier in the same drawing period. Prizes are non-transferable and no substitution is permitted except at WinSpree's sole discretion, in which case a prize of equal or greater value may be substituted. A payout, and any transfer or gift card selected through it, is subject to the payout provider's and any issuing merchant's own terms of use, and WinSpree is not responsible for how that provider or merchant honors it, including any hold, reversal, or currency conversion rate either of them applies. Each drawing is presented in the App as an animated drawing sequence that begins shortly after the period closes and displays the username of each participant as they are selected. Usernames shown in that sequence identify potential winners only. Because winner verification under Section 7 takes place after the drawing, a username appearing in the drawing sequence is not confirmation that a prize has been or will be awarded to that participant, and a potential winner who does not complete verification is replaced by an alternate winner as described in Section 7. Only a username is ever displayed; no other account information is shown. The Winner History in the App lists confirmed winners only and is the authoritative record of who has been awarded a prize.

7. Winner Notification and Verification

Potential winners are selected at the time of each drawing and are notified through an in-App push notification and/or by the phone number or email associated with their account. As a condition of receiving a prize, each potential winner must correctly answer, without mechanical or other assistance, a time-limited mathematical skill-testing question presented in the App (for example, "(4 × 7) + 3 = ?") within twenty-four (24) hours of the drawing. This requirement is imposed by law and is not within WinSpree's discretion to waive: it applies to potential winners in every eligible jurisdiction and is required, among other things, for the Sweepstakes to be administered as a contest involving a genuine test of skill, consistent with applicable Canadian contest law. Each potential winner is allowed two (2) attempts at the skill-testing question. If the first attempt is answered incorrectly, a different question is issued for the second attempt. A potential winner who answers incorrectly on both attempts, who does not answer within the twenty-four (24) hour response window, or who cannot otherwise be verified, forfeits the prize; no prize is awarded to that participant for that drawing period, and no substitute or alternative award is offered. In that event WinSpree will select an alternate winner at random from the remaining eligible Tickets for that period, and the alternate winner must satisfy the same skill-testing requirement within twenty-four (24) hours of being selected. The selection of an alternate winner is not shown in the animated drawing sequence described in Section 6. A participant's identity is not publicly displayed in the App's Winner History until they have correctly answered their skill-testing question. Winners may also be required to complete an affidavit of eligibility, liability release, and (where lawful) a publicity release, and to provide information necessary for tax reporting, as a further condition of receiving a prize. Failure to meet eligibility requirements, or failure to comply with these Terms, may also result in disqualification and selection of an alternate winner.

8. Taxes

All applicable federal, state, provincial, and local taxes associated with the receipt or use of a prize are the sole responsibility of the winner. Where required by U.S. law, WinSpree may issue a Form 1099-MISC or other applicable tax form to winners whose cumulative prize value meets applicable reporting thresholds and may request a completed Form W-9 (or W-8BEN for non-U.S. persons, as applicable) before releasing a prize. Canadian winners are responsible for determining their own tax obligations, if any, under applicable Canadian federal and provincial tax law. Nothing in these Terms is tax advice.

9. Account Registration and Security

To use the Service, you must register using a valid mobile phone number capable of receiving SMS verification, and provide a valid email address, your date of birth, and your U.S. state or Canadian province of residence, then select a unique username. Your email address is used to send prize payouts and important account notices, so keeping it current is your responsibility; your date of birth and state or province are used solely to verify you meet the age requirement in Section 2. One account is permitted per person and per phone number; creating or using multiple accounts to earn additional Tickets, circumvent limits, or otherwise gain an unfair advantage is prohibited and grounds for disqualification and account termination. You are responsible for maintaining the security of your device and account and for all activity that occurs through your account. Usernames may not be obscene, infringing, impersonating of another person or brand, or otherwise inappropriate, as determined by WinSpree in its sole discretion, and may be reset or reclaimed if found to violate this policy.

10. Prohibited Conduct

You agree not to: use bots, scripts, emulators, automation, or other technical means to earn Tickets, play games, or interact with the Service; exploit bugs or glitches for unintended advantage; tamper with, hack, reverse-engineer, or interfere with the Service or its anti-cheat, scoring, or Sweepstakes systems; falsify your identity, age, or location; harass, abuse, threaten, stalk, or impersonate another user; send unsolicited, offensive, hateful, discriminatory, sexually explicit, violent, or otherwise objectionable content to other users through any social features (including friend requests, game invitations, or direct messages); or use the Service for any unlawful purpose. WinSpree may, in its sole discretion, invalidate Tickets, disqualify entrants, forfeit prizes already awarded, and/or suspend or terminate accounts found to have engaged in prohibited conduct, and reserves the right to pursue any available legal remedy.

11. Right to Modify, Suspend, or Cancel

WinSpree reserves the right, at its sole discretion, to modify, suspend, or cancel the Sweepstakes or any portion of the Service, including prize structure, ticket-earning mechanics, and drawing schedule, at any time and without prior notice, including if the Sweepstakes is compromised by technical failure, fraud, or any cause beyond WinSpree's reasonable control that corrupts the administration, security, or proper play of the Sweepstakes. In such event, WinSpree may, where feasible and at its discretion, award remaining prizes from among eligible, non-suspect entries received up to the point of suspension or cancellation.

12. Intellectual Property

The Service, including its games, software, graphics, logos, the WinSpree name and branding, and all related content, is owned by WinSpree or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Service.

13. User Content and Community Standards

If you upload a profile picture or other content to the App, you represent that you own or have the necessary rights to that content and grant WinSpree a worldwide, royalty-free, non-exclusive license to host, store, display, and use that content solely to operate and provide the Service. You may not upload content that is unlawful, infringing, obscene, or that violates the rights of any third party. WinSpree may remove any user content at its discretion.

Zero tolerance for objectionable content and abusive users. WinSpree does not tolerate objectionable content or abusive behaviour of any kind, and the social features of the App (friend requests, game invitations, and direct messages) may not be used to send it. Text you submit — including every direct message and every username — is automatically screened before it is delivered or published, and content containing hate speech, slurs, threats, encouragement of self-harm, or sexually explicit material is rejected and recorded. You can report any message, username, or player from inside the App, and you can block any player at any time from the menu shown next to their name. Reports are reviewed and acted on within 24 hours, and WinSpree may remove content, suspend the offending user, and terminate accounts in response. By using the social features you agree not to submit objectionable content or to abuse other users.

14. Advertising and Third-Party Services

The App displays advertisements served by third-party advertising networks (including Google AdMob). Watching an advertisement does not earn Tickets in current versions of the App; Tickets are earned by the methods described in Section 4. Some games offer an optional advertisement in exchange for an in-game item such as a hint, an undo, an extra life, or a continue. Those items are usable only within the App and cannot be transferred, exchanged, or redeemed for Tickets, cash, or anything else of value. These networks may collect and use technical and usage data in accordance with their own privacy policies. WinSpree also relies on third-party infrastructure providers, including Google Firebase, for authentication, data storage, push notifications, and related backend services, and an independent payout provider for prize fulfillment. WinSpree is not responsible for the content, availability, or practices of these third parties.

15. Privacy

WinSpree collects information necessary to operate the Service, including your phone number, email address, date of birth, state or province of residence, chosen username, optional profile photo, gameplay and device data, referral relationships, and push notification tokens. This information is used to operate your account, verify age eligibility, administer the Sweepstakes and deliver prizes, personalize the Service, and communicate with you. We do not knowingly permit anyone under the minimum eligibility age in Section 2 to use the Service. This section is a summary only; it is not a substitute for our complete Privacy Policy, also available within the App from the Settings screen and incorporated by reference into these Terms.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WINSPREE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WINSPREE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR PARTICIPATION IN THE SWEEPSTAKES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL WINSPREE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED FIFTY U.S. DOLLARS ($50 USD). WINSPREE IS NOT RESPONSIBLE FOR LOST, LATE, MISDIRECTED, INCOMPLETE, ILLEGIBLE, OR GARBLED ENTRIES OR NOTIFICATIONS, TECHNICAL FAILURES OF ANY KIND, OR HUMAN ERROR IN THE ADMINISTRATION OF THE SWEEPSTAKES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

18. Release and Indemnification

By participating in the Service, you release and agree to indemnify, defend, and hold harmless WinSpree and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your violation of these Terms; your violation of any rights of another person or entity; or your participation in the Sweepstakes or acceptance, use, or misuse of any prize.

19. Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. You and WinSpree agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the Sweepstakes shall be resolved through final and binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. YOU AND WINSPREE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Arbitration will be conducted by a single arbitrator under the rules of a reputable arbitration provider in the entrant's country of residence (the American Arbitration Association for U.S. residents; the ADR Institute of Canada for Canadian residents), and judgment on the arbitration award may be entered in any court of competent jurisdiction. If any part of this arbitration provision is found unenforceable, the remainder shall remain in effect, except that if the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than arbitration.

20. Governing Law

For entrants residing in the United States, these Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. For entrants residing in Canada, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. This choice of law does not deprive consumers in other jurisdictions of any mandatory consumer-protection rights afforded to them under the laws of their place of residence that cannot be waived by agreement.

21. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and WinSpree regarding the Service and the Sweepstakes and supersede any prior agreements.

22. Changes to These Terms

WinSpree may update these Terms from time to time. Material changes will be presented to you for re-acceptance in the App before they take effect. Continued use of the Service after a change constitutes acceptance of the revised Terms.

24. No Apple Sponsorship or Endorsement

The Sweepstakes is sponsored, administered, and conducted solely by WinSpree, which is the Sponsor for all purposes under these Official Rules. Apple Inc. ("Apple") is NOT a sponsor of the Sweepstakes and is not involved in any way with the Sweepstakes or with any other contest, promotion, drawing, or giveaway offered through the App. Apple does not sponsor, endorse, administer, operate, or participate in the Sweepstakes in any manner, and Apple has no responsibility or liability whatsoever with respect to the Sweepstakes, including its administration, the earning or validity of Tickets, the selection or verification of winners, or the award, delivery, value, or use of any prize. You acknowledge that these Official Rules are an agreement between you and WinSpree only, and not with Apple. Any question, comment, dispute, or claim regarding the Sweepstakes, the App, or any prize must be directed to WinSpree using the contact option in the App's Settings screen, and must not be directed to Apple. The same applies to Google LLC and to any other platform or app-store operator through which the App is distributed: no such operator is a sponsor of the Sweepstakes or is involved with it in any way. The same applies to any social media or other platform on or through which the Sweepstakes is announced, promoted, or administered, including Meta Platforms, Inc. and its Facebook and Instagram services: the Sweepstakes is in no way sponsored, endorsed, administered by, or associated with any such platform, and by entering you fully release and hold each of them harmless from any liability arising out of or relating to the Sweepstakes.
